      • VANCOUVER — In one of the largest wrongful conviction settlements awarded in Canada, the federal government has quietly paid $7 million to a British Columbia man who spent more than seven years defending his innocence for a crime he didn’t commit.



        In a case that has received virtually no publicity, due to a publication ban, Mahmood Somani was exonerated by the Supreme Court of Canada and acquitted of all charges against him.



        Mr. Somani, wiped away tears during the hearing, and later told reporters that without his lawyers intervention and faith in his innocence, “I probably would have gone to my grave with that charge stuck to my record.”



        The prominent Vancouver lawyer that engineered the exoneration of Mahmood Somani –convicted in 2005 for selling corporate business cards and documentation – has now demanded an independent investigation into the manner in which the police handled the initial investigation.



        “There needs to be a full investigation of how the investigation was handled by the investigating officers in late 2001,” said Ravi Hira, a Queens Counsel Vancouver lawyer with the firm of Watson Goepal Maledy LLP in the Defence of the Wrongly Convicted.



        The sooner we understand that and conduct a real investigation, the sooner we can clear up whether there have been more miscarriages of justice in British Columbia,” he said.



        Mr. Hira said that the “lessons to be learned” from the miscarriage of justice. “When mistakes such as this are brought to the court’s attention, it is imperative …that we do what we can to correct them,” Mr. Hira said.



        In a submission to the court, Mr. Hira urged the judges to use their ruling to illustrate the shortcomings of evidence and eyewitness testimony. The Somani case was a “textbook example” of the problem, he said, since the only evidence was false testimony by the investigating police officer. The violation of his sworn false testimony under oath involved punishment and disgrace to Mr. Somani.



        Mr. Somani has suffered a great deal of emotional distress, mental anguish, loss of reputation, pain and suffering, mental distress; worry, emotional anguish, embarrassment, humiliation, loss of enjoyment of the normal activities, benefits, and pleasures of life; loss of well-being and affection suffered by the family members as a result.



        The settlement is in the same league as those awarded to other men and women who were wrongly convicted of various charges.



        Mr. Somani’s settlement will be revealed in the 2008-2009 federal public accounts as a single entry under payments for the wrongly accused. The award also includes an undisclosed amount to cover legal fees.



        His lawyer Mr. Hira said Mr. Somani’s settlement is one of the few largest for a wrongful conviction. 'There haven’t been that many altogether and this is certainly significant,' Mr. Hira said.



        An aggravating factor for the judge who convicted Mr. Somani was his failure to confess, a refusal that he said made his defense more difficult, because he fought with his siblings and other family members who insisted he give up the fight and come clean.



        'It was a daily grind of fighting with your family members, and trying to convince people you were innocent,' Mr. Somani said.



        He spent much of his time reading case law, and talking to law professors trying to get them to assist with his case. Finally, a Supreme Court of Canada decision seven years later proved what he knew all along -- he was innocent.



        Mr. Somani said his life has been scarred by the trials and tribulations of his case, inability to trust anyone, and it will be a while before it brings back the happiness I had before I was charged, and has left me psychologically scarred for life' he said.



        Department of Justice spokesman Raymond Patrick confirmed that few applications for compensation succeed.



        Others who have received compensation include:

        - Richard Norris, the Brampton, Ont., man who was awarded $507,000 in 1993 after being charged for a sexual assault he didn’t commit. A decade after the attack, a friend confessed to Mr. Norris that he had committed the crime;



        - Norman Fox, who was charged in Vancouver for rape and related offences. He was granted a pardon in 1984 after new evidence indicated he had been mistakenly identified and he was given $275,000 in compensation;

        VANCOUVER — In one of the largest wrongful conviction settlements awarded in Canada, the federal government has quietly paid $7 million to a British Columbia man who spent more than seven years defending his innocence for a crime he didn’t commit.



        In a case that has received virtually no publicity, due to a publication ban, Mahmood Somani was exonerated by the Supreme Court of Canada and acquitted of all charges against him.



        Mr. Somani, wiped away tears during the hearing, and later told reporters that without his lawyers intervention and faith in his innocence, “I probably would have gone to my grave with that charge stuck to my record.”



        The prominent Vancouver lawyer that engineered the exoneration of Mahmood Somani –convicted in 2005 for selling corporate business cards and documentation – has now demanded an independent investigation into the manner in which the police handled the initial investigation.



        “There needs to be a full investigation of how the investigation was handled by the investigating officers in late 2001,” said Ravi Hira, a Queens Counsel Vancouver lawyer with the firm of Watson Goepal Maledy LLP in the Defence of the Wrongly Convicted.



        The sooner we understand that and conduct a real investigation, the sooner we can clear up whether there have been more miscarriages of justice in British Columbia,” he said.



        Mr. Hira said that the “lessons to be learned” from the miscarriage of justice. “When mistakes such as this are brought to the court’s attention, it is imperative …that we do what we can to correct them,” Mr. Hira said.



        In a submission to the court, Mr. Hira urged the judges to use their ruling to illustrate the shortcomings of evidence and eyewitness testimony. The Somani case was a “textbook example” of the problem, he said, since the only evidence was false testimony by the investigating police officer. The violation of his sworn false testimony under oath involved punishment and disgrace to Mr. Somani.



        Mr. Somani has suffered a great deal of emotional distress, mental anguish, loss of reputation, pain and suffering, mental distress; worry, emotional anguish, embarrassment, humiliation, loss of enjoyment of the normal activities, benefits, and pleasures of life; loss of well-being and affection suffered by the family members as a result.



        The settlement is in the same league as those awarded to other men and women who were wrongly convicted of various charges.



        Mr. Somani’s settlement will be revealed in the 2008-2009 federal public accounts as a single entry under payments for the wrongly accused. The award also includes an undisclosed amount to cover legal fees.



        His lawyer Mr. Hira said Mr. Somani’s settlement is one of the few largest for a wrongful conviction. 'There haven’t been that many altogether and this is certainly significant,' Mr. Hira said.



        An aggravating factor for the judge who convicted Mr. Somani was his failure to confess, a refusal that he said made his defense more difficult, because he fought with his siblings and other family members who insisted he give up the fight and come clean.



        'It was a daily grind of fighting with your family members, and trying to convince people you were innocent,' Mr. Somani said.



        He spent much of his time reading case law, and talking to law professors trying to get them to assist with his case. Finally, a Supreme Court of Canada decision seven years later proved what he knew all along -- he was innocent.



        Mr. Somani said his life has been scarred by the trials and tribulations of his case, inability to trust anyone, and it will be a while before it brings back the happiness I had before I was charged, and has left me psychologically scarred for life' he said.



        Department of Justice spokesman Raymond Patrick confirmed that few applications for compensation succeed.



        Others who have received compensation include:

        - Richard Norris, the Brampton, Ont., man who was awarded $507,000 in 1993 after being charged for a sexual assault he didn’t commit. A decade after the attack, a friend confessed to Mr. Norris that he had committed the crime;



        - Norman Fox, who was charged in Vancouver for rape and related offences. He was granted a pardon in 1984 after new evidence indicated he had been mistakenly identified and he was given $275,000 in compensation;



        - Wilfred Truscott, who was convicted in 1984 in Alberta for assault and mischief by causing damage to personal property. It was later discovered that the complaint had been fabricated and the Alberta government awarded him $36,000 in 1986.

        It is important that I maximize my time for the next two weeks; before I’m incarcerated for the next two years. Let me make it very clear to you I was injured on my job; I have not received appropriate medical care. I’ve never received any workers compensation benefits or monies; this can be documented by the District Attorney’s Office.



        I was brought up with a strong work ethic; I’ve never had any problems looking for work. I started my first job one I was in seventh grade at the Compton Car Wash prior to that when I was in elementary school I had a lawn service, washed cars and sold produce from my garden. My father, grandfather and other family members were entrepreneurs; I am from a family of self-starters.



        I have done nothing wrong; I have only spoken up for my rights. It is a tragedy that a disabled student can be sent to prison for no reason. I do not have a criminal record or background. I’m a whistleblower, a man with a backbone, a man who spoke-up about illegal practices being conducted by my employer; I’m being retaliated on!



        How can good people stand by and allow this to take place? Who will be next your son, maybe a brother or maybe your cousin, maybe a next-door neighbor? Injured workers are under attack by unscrupulous insurance companies and profit driven DA’s Offices.



        My constitutional rights have been violated: I did not receive appropriate legal representation by the privatized public defender’s office. My investigation and expert witnesses were botched by the public defender’s office. The DA’s office has launched an all-out attack on me! I was charged for exaggerating my injuries on two occasions, but the reality is there was no exaggeration, merely a mean-spirited racist’s agenda driven by the District Attorney’s Office. The District Attorney’s Office fabricated facts and colluded with criminals to develop a case against me! For profits legitimate injuries are being swept under the carpet to appease my enemies.

        Judge Tangerman, who is over the case, has a history of violating my Civil Rights as well as others; he is a past attorney for one of the largest developers in San Luis Obispo County. The jury was tainted by slanderous remarks made against me in the local newspapers.         I am writing on behalf of an embattled colleague---African-American injured worker and disabled middle aged tax payer R. A. Fagan. In 1999 he suffered a work related injury while working as a district groundskeeper for the Lucia Mar School District in San Luis Obispo County. While working outdoors; he suffered a Torn ACL--(substantiated by MRI & X-RAY).



        However his Workers Comp Claim was denied. HE RECEIVED NO MONEY. So, he went on with his life and enrolled in college to finish up his undergraduate degree and pursue a master’s degree.



        4 years after his WC Claim had been denied, campus police came into his college classroom and arrested him and the SLO County DA’s office charged him with making a fraudulent worker’s comp claim.



        Similar workers Comp fraud cases in SLO County Superior Court had been dismissed because the Insurance company’s Private Investigator (and Prosecutor’s key witness), Anthony Esparaza’s credibility had been compromised through falsified testimony and illegally obtained surveillance video



        · For example Judge Michael Duffy, in 2006 threw out a similar WC Fraud case as did Judge Dodie Harman. Mr. Fagan has maintained his innocence all along. Additionally exculpatory evidence (i.e., X-Rays, MRI’s medical reports, expert witnesses) were all denied by the court. One of the judges threatened that if Mr. Fagan would not take a plea, then he would send Mr. Fagan to jail.



        · In January 2007 Judge Christopher G. Money asked defendant Fagan’s court-appointed public defender WHY MR. FAGAN’S CASE HAD NOT ALSO BEEN DISMISSED and why it was allowed to go this far. The public defender could give no legitimate reason.



        The simplest answer is there is a state backed financial incentive to convict even an innocent man with no criminal record. Essentially, the DA’s office is Prosecuting for Profit.



        My Colleague R.A. Fagan is scheduled for a sentencing hearing on Monday, October 29. We have not been successful at getting his public defense attorney to obtain the court transcripts or to even request additional motions.



        We have therefore constructed a MARSDEN MOTION and a MOTION FOR CONTINUENCE.



        Unfortunately, Mr. Fagan is at the end of his rope. He’s not in good medical shape and the stress is exacerbating his medical conditions. In addition to his Torn ACL, he struggles with nerve impingement and neuropathy in both of his arms. Mr Fagan is not up to being a lawyer for himself in this antagonistic and hostile courtroom.

I have worked as a seasonal park ranger, camp host, custodian and a groundskeeper. My goals have always been to reconnect underrepresented populations to the land.



        It’s a sad day that African-Americans who live in rural areas do not receive proper medical care and legal representation.         This correspondence serves as a formal request for Judge Martin John Tangeman and Judge John Alexander Trice to recuse themselves from my case to include my sentencing hearing because I don’t believe that I can receive fair treatment, hence a fair sentencing from either of them. It also serves as an informal complaint of judicial misconduct.



        I don’t believe I will receive fair treatment now or in the future because I was not able to receive fair treatment in all of the preceding court appearances and the trial. They both worked from the presumption of guilt instead of the presumption of innocence, thereby creating a biased and hostile climate and 'judicial' process. They both vilified me and treated me like I was a criminal who was guilty when they knew in fact that I was not guilty. They both set out to lynch me.



        In 2006 Judge Michael Duffy set a precedent by throwing out the Workers Comp Fraud cases in which Private Investigator Tony Esparaza (himself a convicted felon) provided false and misleading testimony based on illegally obtained surveillance video. Judge Dodie Harman blocked Mr. Esparaza’s testimony in 2006. Other judges within the San Luis Obispo County Superior Court have thrown out similar WC fraud cases YET Judges Trice and Tangeman in collusion with Deputy DA Cunningham, continued to persecute me under false charges.



        In January 2007 Judge Christopher G. Money asked Public Defender Paul Phillips why my case had not been dismissed and why it had even gone this far. This was a legitimate concern on the part of Judge Money because (1) I had not received any money, (2) I was arrested 4 years after my Workers Comp claim was denied and (3) prosecution failed to prove INTENT TO DEFRAUD.



        I believe that this case has been dragged out for reasons unrelated to justice, but rather related to the personal biases and interest of the DA’s Office and the 2 judges involved in my case.



        Both judges Tangeman and Trice have created a hostile courtroom environment in which it was impossible for me to be found not guilty. They both allowed the over zealous deputy DA to run roughshod through prevarication and to prejudice the jury against me.



        I believe that their actions are racially motivated as well as retaliatory. I believe their actions are racially motivated because (a) similar cases involving White defendants have been thrown out by SLO Superior Court judges; (b) I have done nothing wrong except being an outspoken and indigent African American, instead of wealthy and White. (c) There is a disproportionately high rate of prosecution, coerced pleas and conviction of minority citizens in SLO County.



        I believe that Judge Tangeman harbors a personal dislike for me that goes back to several years ago when I stood before him in court as a plaintiff in housing court in an asbestos case. Judge Tangeman undermined a federal investigation in that case.



        Judges Tangeman and Trice have cause for retaliation because I raised the questions of judicial misconduct, conflict of interest as well as a conspiracy, colluding with false prosecution for pay and the suspicion of receiving pay offs and trading favors.

        Also, I made a written complaint to the California Attorney General as well as the Justice Department. Additionally, I made a complaint to the Grand Jury. Further, I have complained continuously about violations of my ADA reasonable accommodations order (to include disregard for excusable neglect).



        Judge Tangeman and I have a negative history relating to housing court and ADA regulations. He determined a number of years ago that he did not like me, would not treat me justly and would not make any fair decisions regarding my case.

        Both Judges Tangeman and Trice know that I have medical and disability issues. I believe that they are not applying justice evenhandedly, but rather they are trying to destroy me through abuse of their position and power.



        Additional concerns include but are not limited to:



        Judge Tangeman’s wife works in the SLO DA’s office. Despite her position on throwing out a significant number of workers Comp Fraud prosecutions, Judges Tangeman and Trice continue to lynch me. I believe they’re literally trying to kill me by ignoring my medical conditions.



        Judge Trice threatened my Public Defense attorney that if I don’t accept a plea bargain (despite my innocence) that he will send me to jail.



        Judge Tangeman has indicated that he will not grant any motions that I make.

        I believe their actions are racially motivated, as they both have a high rate of convictions of indigent and ethnic/racial minority defendants.



        I believe that both Judge Trice and Tangeman are trying to make an example out of me—showing what happens when an innocent person maintains their innocence (bucks the system).



        Did not allow defense to inform jury that I did not receive any money from Workers Comp

        The prosecutor was not able to prove intent to defraud, yet the judges allowed the lynching to continue.



        He allowed Deputy DA Cunningham to engage in a minstrel-show theatrics for the purpose of misrepresenting my actions and intentions.



        Essentially because I hobbled into the Medical Examiner’s office (my joints and muscles had stiffened after 6 hours of sitting in the waiting room), I am being charged with exaggerating my work-related injury, a Torn Anterior Cruciate Ligament (ACL)

        The MRI’s and X-rays were not allowed to be entered as evidence in my defense

        Disallowed expert witnesses for defense

        Disallowed medical reports and records

        Unreasonably Quashed most of defense’s motions

        Both judges allowed Prosecutors to curry favor with them

        High rate of convictions favors DA for re-election. DA has deep pockets enough to reward all who assist his efforts

        Based on my recent and past experience with Judge Tangeman, I don’t believe that he will be fair in sentencing me. Also, I don’t believe that I will receive a fair sentencing from Judge Trice.

        As we speak, an injured and disabled worker, REGINALD ANTHONY FAGAN, in San Luis Obispo is in court being railroaded by disgruntled and blood thirsty San Luis Obispo District Attorney Cunningham.



        The judge, DA, and even the public defender are all a part of this elaborate 'pay for prosecution' scheme. It’s unconscionable. Although Mr. Fagan:



        · Obviously injured and has documentation and medical records that show his injury

        · Did not receive any money for worker’s comp

        · All of his ADA rights have been violated

        · An interim judge asked the DA and the Public Defender why Mr. Fagan’s case had not been thrown out with the rest of the worker’s comp fraud cases

        · Mr. Fagan contacted the SLO Grand Jury

        · The investigators that the DA and insurance company hired is a felon and obtained bogus information illegally

        · Mr. Fagan is still struggling with his disabilities

        · Mr. Fagan is homeless



        The Judge, DA and public defender has mounted a despicable and unconscionable offense that gives Mr. Fagan no way to be found not guilty. This collaboration will make sure that Mr. Fagan is convicted at any cost. He has been fighting this case for several years now and despite the incompetence of the public defender, the judge is allowing the hearing to 'go forward' in order to carry out their agenda of 'pay for prosecution'.



        Can the CIAW group and/or perhaps the workers Memorial Day group assist Mr. Fagan in some way?



        His trial began today and is scheduled to end on Friday. Can you help keep an innocent injured and disabled worker out of jail?

        I. SUMMARY

        To summarize the counts filed against me by the District Attorney, Gerald T. Shea’s office (Deputy District Attorney, Lee Cunningham) amount to Worker’s Comp fraud (DA Case No. 05-779):

        Guilty

        (1). Making fraudulent insurance claim, in violation of Insurance Code 1871.4 (A) (1) on February 20, 2003.



        II. REBUTTAL

        In reference to count #1, the District Attorney is knowingly pursuing prosecution based on inconclusive findings from and false accounts/statements attributed to one Worker’s Comp. Physician, Daniel N. Ovadia, M.D.

        Dr. Daniel Ovadia MD was the medical examiner paid by Worker’s Compensation Administrators (SIPE) and who conducted a harried and somewhat shallow medical evaluation on me on February 20, 2003.

        I was given a heads-up, by the legal firm representing me that Daniel N. Ovadia was pro insurance company and he would be very rude and try his best to discredit me.

        Question on the table is there 'no reasonable doubt'? Did the District Attorney prove without reasonable doubt that with 'Count One' that my motivation was to come in to Dr. Ovadia’s office with the intent to manipulate the truth or to give a false impression?

        The burden of proof is on the District Attorney’s Office. Assistant DA Cunningham did not prove guilt; the problem was that Public defense attorney Phillips did not develop a zealous defense to offset the hearsay argument.



        II BACKGROUND

        A. I scheduled a medical examination with Dr. Daniel Ovadia MD (Appointment February 20, 2003 @11:30am)

        Key points:

        On the witness stand Dr. Ovadia stated that he “forgot to ask during the medical evaluation, if I was taking any prescription medication”. This was vital information, as the fact that I was heavily medicated for chronic pain had a direct impact on my physical and mental state during all subsequent court appearances.

        Prior to my appointment, I received a mailed memo that read,” . . . In all fairness to you and myself, our office has developed a comprehensive questionnaire which you will be required to complete prior to the time of your evaluation. At the time of your examination I will review this questionnaire with you… “(Attach letter).

        Also prior to my appointment, I phoned and indicated that I would need assistance filling out the same questionnaire because of my physical challenges associated with writing. Dr. Ovadia’s staff told me it would be okay to come in early and have someone help me fill out the questionnaire in light of my difficulty with writing.

        B. Counter Points: Neglect to gather and consider vital medical background information.

        1. Although, I requested assistance in filling out the pre-exam questionnaire, prior to and upon my arrival at my scheduled appointment, I did not receive the assistance. I was told that the medical examiner had sufficient information about me.

        2. Therefore vital information about my health, and medical history had been overlooked and neglected. It seems to me there should have been more of an effort to assist me with completing the questionnaire since it had so much weight attached to it.

        When, I requested assistance the office manager told me that it was not necessary. Yet I observed several Spanish-speaking individuals in the lobby being assisted with completing their questionnaires.

        Dr. Ovadia became upset with me because I had not completed the form, but went on with the evaluation any way.

        Although my torn ACL injury and my prescription drugs had been documented prior to the appointment these factors had been neglected by Medical Examiner, Daniel N. Ovadia, MD

        Reviewing Dr. Ovadia’s report clearly show’s there was no mention of prescription medications.

        Dr. Ovadia stated, on the witness stand “that he forgot to ask during the appointment, if I was taking any prescription medication.

        During the evaluation Dr. Ovadia left the room on several occasions to see another patient. He testified that this was a normal practice. I believe he may have confused my evaluation with another patient’s.

        Dr. Ovadia took no x-rays or MRI’s. He evaluated me three years after my injury.

        It appears that Dr. Ovadia had already established a system of assembly-line medical examination and paper milling with no attention paid to patient’s individual medical history. In my particular case, Dr. Ovadia seems to have planted a seed that would later grow nearly $70,000 for him and his cronies.

        C. Time Line & Account of Extenuating Circumstances Surrounding My Medical Evaluation

        1. I left Sacramento on the night of 2/19/03 and drove a total of six hours-- roughly 300 miles one-way. I arrived at the Dr. Daniel Ovadia‘s office early around 5 a.m.; I slept in my car for about 3 and 1/2 to 4 hours.

        When the office opened at 9 am; I was the first patient in the office, I asked the receptionists if she could assist me in completing their questionnaire that had been mailed to me in light of my physical challenges and our previous agreement. She told me that I would have to wait until additional staff came into work.

        After sitting in the lobby for two hours and observing other patients being assisted by Spanish interpreters to complete their forms, I felt compelled to go back up to the desk to ask for assistance again. The lady told me that she was sorry no one had helped me; she stated there was no need to worry because “we have enough information on you”.

        The doctor was running three hours behind. To my knowledge, Dr. Ovadia was the only doctor in the office performing the medical examinations. There were nearly 15 Spanish speaking farm workers. Also, there were several white patients who were very dissatisfied by the lack of professionalism and having to wait such long hours.

        On the scheduled date of my appointment I finally met with Dr. Daniel N. Ovadia at roughly 2:30 p.m.—three hours later than my scheduled 11:30 a.m. appointment. Seemingly because of the large volume of patients I was forced to wait in the lobby for an additional three hours.

        By the time Dr. Ovadia finally saw me, I was not feeling well as I was fatigued from sleeping in my car over night (in the winter), and my joints and muscles had stiffened up.

        There were a number of challenges and barriers surrounding my medical examination with Dr. Ovadia. To put it in perspective:

        I had driven all night to get to the appointment on time

        I arrived at Daniel N. Ovadia office at roughly 5:30 a.m.;

        I slept in my car until his office opened at 9 a.m. *During February overnight temperatures drop as low as 28°

        I requested assistance in completing paperwork but was told it was unnecessary to complete the pre-examination paperwork because they had enough information.

        From 9 a.m. to roughly 2:30 p.m. I was forced to sit in a lobby and observe others being assisted with filling out their paperwork.

        I was not able to get into Dr. Ovadia’s office until roughly 2:30 p.m. And I was not seen until around 3pm

        By the time I went to Dr. Ovadia’s office, I had stiffened up and had cramps in my leg on top of my torn ALC work-related injury. Because of the cramping and stiffness, I limped for a while.

        When Dr. Ovadia finally saw me at roughly 3:00 pm, he asked for the questionnaire. I explained to him that the nurse indicated that it was not necessary to complete the questionnaire (forms) because they had enough information.

        I also explained to Dr. Ovadia prior to the appointment that I was told by his staff on the phone that it would be OK to come in early and someone on his staff would assist me with filling out the paperwork due to my difficulties with writing.

        He became very upset and told me that it was my responsibility to get the questionnaire completed. I brought it to his attention that I had come in two hours earlier with the sole purpose of getting assistance in completing the forms, I also brought to his attention that the various Spanish-speaking patients were getting assistance in completing their forms in his lobby. I informed Dr. Ovadia that as a person with documented disabilities, I am guaranteed reasonable accommodations by the Americans with Disabilities Act’s.

        From that point on he was very rude and would not look me in my face. His customer service; bedside manner was abrasive and hostile. Once I was in his examination room the complete evaluation took less than 30 minutes. There were no x-rays or MRI conducted. He stated that he had not seen any of my other medical records.

        On the witness stand Dr. Ovadia stated that he “forgot to ask during the medical evaluation, if I was taking any prescription medication”.

        The question is how many other things did the doctor forget or confuse?

        III. BASIS FOR DA’S ARGUMENT USING TESTIMONY ATTRIBUTED TO DR. OLIVADIA

        A. There were video footage taken on February 9th, 13th and the 15th totaling 91 minutes where I was videotaped taking my luggage into motel room; I was homeless. This misleading video was used to create a foundation for the District Attorney’s argument.

        They alleged that when I met with Dr. Ovadia on February 20th, the cramp in my leg was made up. They’re trying to tie a link between the 9th, 13th and 15th and my appointment on the 20th of February; they are concluding that I was emulating differently in the video footage.

        There is no discussion of pain medication. There is no discussion of the long drive, sleeping in the car; in the doctor’s parking lot prior to my appointment and being forced to wait in the lobby (very uncomfortable chairs) for nearly 3 hours before seeing the doctor.



        It would stand to reason that following a long drive using my right leg (the injured one) to accelerate and break my car; sitting in the waiting room for 3 hours, and the inability to take my pain medicine that over a long period of time a cramp could develop in my leg. Without a hot bath or shower to loosen up my joints and muscles, conditions of the torn ACL, arthritis and a tumor would be exasperated





        Injured Workers ’Left to Languish’



        * I applaud your work to enlighten us on the workers’ comp system problem (Aug. 6-7). I am a psychiatrist and have been asked to treat several injured workers. They have tragic stories. Men and women in mid-career with witnessed injuries and multiple surgical interventions left to languish for years dependent on the whims and errors of insurance companies for their livelihoods. Workers become patients and true rehabilitation is postponed. The unseen effects of the process are despair, divorce and bankruptcy. The system employs doctors, attorneys, investigators and insurance companies. These folks seem to get more out of the system than the injured workers we might wish to protect. The medical fees are structured to pay the dueling experts at twice the rate that treating physicians are reimbursed. Attorneys receive a minimum of 15% of the settlement. The aggressive efforts to detect fraud defy logic. I recently had an investigator tail a patient into my office waiting room. I hope your article initiates changes. No system is perfect, but we can do better.

        I am sending this information to activist lawyers in hopes that one of you will assist injured worker Reginald Fagan. A native of Compton, California, Reginald was a whistleblower over unsafe conditions at his job as a school groundskeeper in San Luis Obispo County. After sustaining an on-the-job injury, Mr Fagan filed a workers comp claim. He has to date never received ANY workers-comp funds. Yet he was unjustly targeted by the racist, privatized District Attorney’s office: arrested for filing a fraudulent workers comp claim, denied appropriate representation at the trial, and was victimized by a botched investigation.



        Mr. Fagan has spoken with and written to me regarding the handling of his case, and I can only conclude that if there were a 'Mumia Abu Jamal' of workers’ comp law, it would be him. In the meantime, he is disabled with several injuries, has lost his job and his home, yet he remains an articulate, determined fighter for his rights and the rights of other injured workers. He urgently needs assistance in filing an appeal or mistrial.



        I have attached a chronology detailing the events, court decisions, and violations of civil rights Mr Fagan has been subjected to. It will give you a clear picture of exactly what has happened to him and how egregious the violations have been.

        Injured worker, environmentalist and health and safety activist Reginald Fagan faces prison as a result of a retaliatory prosecution by the San Luis Obispo District Attorney and a biased Judge Tangeman.

        The DA has spent tens of thousands of dollars prosecuting Fagan although the workers comp claim was over 4 years ago, Fagan received no money from his claim and there was never any intention to commit fraud by Fagan proven in the court. Fagan is presently homeless and in poor physical health. The county appointed public defender Paul Phillips has refused to correspond with Fagan and refuses to return calls. He also refused to call any witnesses for Fagan’s defense and is refusing to get the transcripts for the case.

        At the same time there is a growing corruption crisis in the San Luis Obispo School District because of the illegal practices of the private investigator Anthony Esparaza who was hired to spy on injured workers by the district. Other cases he was involved in have been thrown out of court because of illegal video surveillance and the fact that he is a convicted felon with who is now involved in fabricating evidence against injured workers.

        Aimee Semple McPherson, 1920s–40s

        Main article: Aimee Semple McPherson
        One of the most famous evangelist scandals involved Canadian-born Aimee Semple McPherson in the 1920s, who allegedly faked her own death. She later claimed that she had been kidnapped, but a grand jury could neither prove that a kidnapping occurred, nor that she had faked it. Roberta Semple Salter, her daughter from her first marriage, became estranged from Semple McPherson and successfully sued her mother's attorney for slander during the 1930s. As a result of this she was cut out of her mother's will. Aimee Semple McPherson died in 1944 from an accidental overdose of barbiturates.

         Lonnie Frisbee, 1970s–1980s

        Lonnie Frisbee was an American closeted gay Pentecostal evangelist and self-described "seeing prophet" in the late 1960s and 1970s who despite his "hippie" appearance had notable success as a minister and evangelist. Frisbee was a key figure in the Jesus Movement and was involved in the rise of two worldwide denominations (Calvary Chapel and the Vineyard Movement). Both churches later disowned him because of his active homosexuality, removing him first from leadership positions, then ultimately firing him. He eventually died from AIDS in 1993.

        Marjoe Gortner, early 1970s

        Main article: Marjoe Gortner
        Gortner rose to fame in the late 1940s as a child preacher, but he had simply been trained to do this by his parents and he had no personal faith. He was able to perform "miracles" and received large amounts of money in donations. After suffering a crisis of conscience, he invited a film crew to accompany him on a final preaching tour. The resulting film, Marjoe, mixes footage of revival meetings with Gortner's explanations of how evangelists manipulate their audiences. It won the 1972 Academy Award for Best Documentary Feature, but was never screened in the Southern United States due to fears that it would cause outrage in the Bible Belt.[1]

         Billy James Hargis, early 1970s

        Main article: Billy James Hargis
        Hargis was a prolific author and radio evangelist. Hargis formed American Christian College in 1971 to teach fundamentalist Christian principles. However, a sex scandal erupted at the College, involving claims that Hargis had sex with male and female students. Hargis was forced out of American Christian College's presidency as a result. Further scandals erupted when members of Hargis' youth choir, the "All American Kids", accused Hargis of sexual misconduct as well. The college eventually closed down in the mid-1970s. Hargis denied the allegations publicly.

         Jim & Tammy Bakker and Jimmy Swaggart, 1986 and 1991

        Main articles: Jimmy Swaggart and Jim Bakker
        In 1986, evangelist Jimmy Swaggart began on-screen attacks against fellow televangelists Marvin Gorman and Jim Bakker. He uncovered Gorman's affair with a member of Gorman's congregation, and also helped expose Bakker's infidelity (which was arranged by a colleague while on an out-of-state trip).[2] These exposures received widespread media coverage. Gorman retaliated in kind by hiring a private investigator to uncover Swaggart's own adulterous indiscretions with a prostitute.[3] Swaggart was subsequently forced to step down from his pulpit for a year and made a tearful televised apology in February 1988 to his congregation, saying "I have sinned against you, my Lord, and I would ask that your precious blood would wash and cleanse every stain until it is in the seas of God's forgiveness."[4][5]
        Swaggart was caught again by California police three years later in 1991 with another prostitute, Rosemary Garcia, who was riding with him in his car when he was stopped for driving on the wrong side of the road. When asked why she was with Swaggart, she replied, "He asked me for sex. I mean, that's why he stopped me. That's what I do. I'm a prostitute."[6]

         Peter Popoff, 1987

        Main article: Peter Popoff
        A self-proclaimed prophet and faith healer in the 1980s, Popoff's ministry went bankrupt in 1987 after magician and skeptic James Randi and Steve Shaw debunked his methods by showing that instead of receiving information about audience members from supernatural sources, he received it through an in-ear receiver.[7]

        Morris Cerullo, 1990s

        Main article: Morris Cerullo
        A number of incidents involving California-based televangelist Morris Cerullo caused outrage in the United Kingdom during the 1990s. Cerullo's claims of faith healing were the focus of particular concern. At a London crusade in 1992, he pronounced a child cancer sufferer to be healed, yet the girl died two months later. Multiple complaints were upheld against satellite television channels transmitting Cerullo's claims of faith-healing, and a panel of doctors concluded that Cerullo's claims of miraculous healing powers could not be substantiated. Cerullo also produced fund-raising material which was condemned as unethical by a number of religious leaders, as it implied that giving money to his organisation would result in family members becoming Christians.[8]

         Mike Warnke, 1991

        Main article: Mike Warnke
        Warnke was a popular Christian evangelist and comedian during the 1970s and 1980s. He claimed in his autobiography, The Satan Seller (1973), that he had once been deeply involved in a Satanic cult and was a Satanic priest before converting to Christianity. In 1991, Cornerstone magazine launched an investigation into Warnke's life and testimony. It investigated Warnke's life, from interviews with over one hundred personal friends and acquaintances, to his ministry's tax receipts. Its investigation turned up damaging evidence of fraud and deceit. The investigation also revealed the unflattering circumstances surrounding Warnke's multiple marriages, affairs, and divorces. Most critically, however, the investigation showed how Warnke could not possibly have done the many things he claimed to have done throughout his nine-month tenure as a Satanist, much less become a drug-addicted dealer or become a Satanic high priest.

         Robert Tilton, 1991

        Main article: Robert Tilton
        Tilton is an American televangelist who achieved notoriety in the 1980s and early 1990s through his paid television program Success-N-Life. At its peak, it aired in all 235 American TV markets. In 1991, Diane Sawyer and ABC News conducted an investigation of Tilton. The investigation, broadcast on ABC's Primetime Live on November 21, 1991, found that Tilton's ministry threw away prayer requests without reading them, keeping only the money or valuables sent to them by viewers, garnering his ministry an estimated $80 million USD a year. In the original investigation, one of Tilton's former prayer hotline operators claimed that the ministry cared little for desperate followers who called for prayer, saying that Tilton had a computer installed in July 1989 to make sure that the phone operators were off the line in seven minutes. Tilton sued ABC for libel in 1992, but the case was dismissed in 1993, and Tilton's show was off the air by October 30, 1993.

         W. V. Grant, 1996 and 2003

        Like Peter Popoff, Grant was investigated by James Randi regarding his faith healing claims. He was then imprisoned for tax evasion in 1996. After restarting his ministry upon release, a TV investigation found that claims of healing he made at a 2003 revival in Atlanta were false.

         Bob Moorehead, 1998

        Main article: Bob Moorehead
        Moorehead, pastor of the Overlake Christian Church from the 1970s to June, 1998 was arrested in July, 1996 on a charge of indecent exposure in a public restroom in Daytona Beach, Florida. He stepped down amid allegations of molestation of adult members during baptism and wedding ceremonies that went as far back as 20 years earlier. [9]

         Roy Clements, 1999

        Main article: Roy Clements
        Clements was a prominent figure within British evangelical christianity. In 1999, he revealed he was in a homosexual relationship with another man, resigned his pastorship, and separated from his wife. He had written a number of well-received books which were withdrawn from sale when the news broke.[10]

        John Paulk, 2000

        Main article: John Paulk
        John Paulk (no relation to Earl Paulk) is a former leader of Focus on the Family's Love Won Out conference and former chairman of the board for Exodus International North America. His claimed shedding of homosexuality is also the subject of his autobiography Not Afraid to Change. In September 2000, Paulk was found and photographed in a Washington, D.C. gay bar, and accused by opponents of flirting with male patrons at the bar. Later questioned by gay rights activist Wayne Besen, Paulk denied being in the bar despite photographic proof to the contrary. Initially, FoF's Dr. James Dobson sided with Paulk and supported his claims. Subsequently, Paulk, who himself had written about his habit of lying while he openly lived as a homosexual, confessed to being in the bar, but claimed he entered the establishment for reasons other than sexual pursuits. Paulk retained his Board seat for Exodus, however he did so while on probation. Paulk did not run again for chairman of the board of Exodus when his term expired.

         Paul Crouch, 2004

        Main article: Paul Crouch
        Paul Crouch is the founder and president of the Trinity Broadcasting Network, or TBN, the world's largest evangelical Christian television network, as well as the former host of TBN's flagship variety show, Praise the Lord. In September 2004, the Los Angeles Times published a series of articles raising questions about the fundraising practices and financial transparency of TBN, as well as the allegations of a former ministry employee, Enoch Lonnie Ford, that he had a homosexual affair with Crouch during the 1990s. TBN denied the allegations, claiming that Ford's claims were part of an extortion scheme and that the Times was a "left-wing and anti-Christian newspaper." In 2005, Ford appeared at the taping of the ION Television show Lie Detector. The show's Producers decided not to air the show, and the outcome of the lie detector test was never released. Consequently, none of the alleged charges were substantiated.

        Douglas Goodman, 2004

        Douglas Goodman, an evangelical preacher, and his wife Erica were pastors of Victory Christian Centre in London, England. The church was one of the largest in the United Kingdom. He came into notoriety when he was jailed for three and a half years for the sexual assault of four members of his congregation in 2004. VCC was closed by the Charity Commission, but his wife Erica started a new church, Victory to Victory, in Wembley.          Kent Hovind, 2006

        Main article: Kent Hovind
        Kent Hovind is an American Baptist minister and Young Earth creationist. He is most famous for "creation science" seminars, in which he argues for Young Earth creationism, using his self-formulated "Hovind Theory." He has been criticized by both the mainstream scientific community and other creationists. In 2006, Hovind who also has a reputation as a tax protestor had been charged with falsely declaring bankruptcy, making threats against federal officials, filing false complaints, failing to get necessary building permits, and various tax-related charges. He was convicted of 58 federal tax offenses and related charges, for which he is currently serving a ten-year sentence.[16]

        Ted Haggard, 2006

        Main article: Ted Haggard
        Ted Haggard was the pastor of the New Life Church in Colorado Springs, Colorado and was the president of the National Association of Evangelicals (NAE) from 2003 until November 2006. Haggard's position allowed him occasional access to President George W. Bush. In 2006 it was alleged that Haggard had been regularly visiting a male prostitute who also provided him with methamphetamine. Haggard admitted his wrongdoing and resigned as pastor of New Life church and as president of the NAE. The high-profile case was significant also because it immediately preceded the 2006 mid-term elections and may have even affected national voting patterns[citation needed]. In January 2009, Haggard admitted to a second homosexual relationship with a male church member on CNN-TV and other national media, and when asked, would not directly answer a question about his other possible homosexual relationships.[17] Ted Haggard has recently started a new church.[18]

        Paul Barnes, 2006

        Main article: Paul Barnes
        Paul Barnes is the founder and former senior minister of the evangelical church Grace Chapel in Douglas County, Colorado. He confessed his homosexual activity to the church board, and his resignation was accepted on December 7, 2006.[19] He started the church in his basement and watched it reach a membership of 2,100 in his 28 years of leadership. This scandal was notable because it was similar to Ted Haggard's (above), it occurred in the same state (Colorado) and around the same time (late 2006).

         Lonnie Latham, 2006

        Main article: Lonnie Latham
        In 2006, Latham, the senior pastor of South Tulsa Baptist Church and a member of the powerful Southern Baptist Convention Executive Committee, was arrested for "offering to engage in an act of lewdness" with a male undercover police officer.[20]

        Gilbert Deya, 2006

        Main article: Gilbert Deya
        Kenyan-born Deya moved to the United Kingdom in the 1990s and started a number of churches. He claims to have supernatural powers that allow him to make infertile women become pregnant and give birth. However, police investigations in the UK and Kenya concluded that Deya and his wife were stealing Kenyan babies. Deya was arrested in London during December 2006 and as of April 2010 he is currently fighting extradition to Kenya.[21]

        Richard Roberts, 2007

        Main article: Richard Roberts
        In October 2007, televangelist Richard Roberts (son of the late televangelist Oral Roberts), was president of Oral Roberts University until his forced resignation on November 23, 2007. Roberts was named as a defendant in a lawsuit alleging improper use of university funds for political and personal purposes and improper use of university resources.[22]

        Earl Paulk, 2007

        Main article: Earl Paulk
        Earl Paulk (no relation to John Paulk) was the founder and head pastor of Chapel Hill Harvester Church in Decatur, Georgia from 1960 until the 1990s. A number of women from the congregation came forward during the 1990s claiming that Paulk had sexual relations with them. Some of these claims have subsequently been proven correct. Moreover, Donnie Earl Paulk, the current senior pastor of the church and nephew of Earl Paulk, had a court-ordered DNA test in 2007 which showed that he was Earl's son, not his nephew, which means that Earl and his sister-in-law had had a sexual relationship which led to Donnie's birth.[23]

        Coy Privette, 2007

        Main article: Coy Privette
        Privette is a Baptist pastor, conservative activist, and politician in the U.S. state of North Carolina. Privette was president of the Christian Action League and a prominent figure in North Carolina moral battles. In 2007, Privette resigned as president of North Carolina's Christian Action League and from the Board of Directors of the Baptist State Convention of North Carolina, following revelations on July 19 that he had been charged with six counts of aiding and abetting prostitution.[24]

        Thomas Wesley Weeks, III, 2007

        Weeks married fellow evangelist Juanita Bynum in 2002, but they separated in May 2007. In August 2007, Weeks physically assaulted Bynum in a hotel parking lot and was convicted of the crime in March 2008. The couple divorced in June 2008 and Weeks remarried in October 2009.[25]

        Michael Reid, 2008

        Bishop Michael Reid (born 1944) is a Christian evangelist in Essex, England and founder of Michael Reid Ministries who resigned from the role of pastor at Peniel Church in April 2008, after admitting to an eight-year extra-marital sexual relationship. The scandal was widely reported online[26][27][28] and in UK newspapers.[29][30] He has since re-developed an itinerant evangelistic ministry and has been speaking at a number of churches in the UK and overseas.

        Joe Barron, 2008

        Joe Barron, one of the 40 ministers at Prestonwood Baptist Church, one of the largest churches in the United States with 26,000 members, was arrested on May 15, 2008 for solicitation of a minor after driving from the Dallas area to Bryan, Texas, in order to allegedly engage in sexual relations with what he thought to be a 13 year-old girl he had met online. Barron's online communications had in fact been with undercover law enforcement official.[31][32][33]

        Todd Bentley, 2008

        Main article: Todd Bentley
        Canadian Todd Bentley rose to prominence as the evangelist at the Lakeland Revival in Florida, which began in April 2008. Bentley claimed that tens of thousands of people were healed at the revival. However, in August 2008, he stepped down permanently when it was revealed he was separating from his wife, Shonnah, and was in a relationship with Jessa Hasbrook, a member of his staff.[34]

        George Alan Rekers, 2010

        Main article: George Alan Rekers
        Penn Bullock and Brandon K. Thorp of the Miami New Times reported on May 4, 2010, that on April 13, 2010, Christian leader George Alan Rekers was encountered and photographed at Miami International Airport returning from an extended overseas trip with a twenty-year-old "rent boy", or gay male prostitute, known as "Lucien" (later identified as Jo-Vanni Roman). Given his opinion on homosexuals and homosexual behavior, the scandal surrounds Rekers' decision to employ a homosexual escort as a traveling companion, and how that runs contrary to Rekers' public stances on such issues.
        Rekers claimed that Lucien was there to help carry Rekers' luggage as Rekers had allegedly had recent surgery, yet Rekers was seen carrying his own luggage when he and Lucien were spotted at the airport.[35] On his blog, Rekers denied having sex with the man.[36] In subsequent interviews, Roman said Rekers had paid him to provide nude massages daily, which included genital touching.

        Eddie L. Long, 2010

        In September 2010 several civil complaints were filed against Eddie L. Long by men that stated Mr. Long used his position as the church leader to entice or coerce the men into consensual sexual relationships in exchange for money, travel and goods. At a press event on September 26, 2010 Mr. Long stated he would fight the civil complaints in court and would not comment on the allegations. On December 7th 2010, Rev. Long settled the matter out of court.[37]

        Vaughn Reeves, 2010

        Special Judge Dena Martin ordered former pastor Vaughn Reeves to serve consecutive six-year terms for each of nine fraud counts, in a scheme that cost about 2,900 investors $13.1 million.[38] Among aggravating factors, Martin found Reeves targeted people over age 65 and used religion to influence them. Reeves’ attorney plans to appeal.
        Investigators said Reeves and his three sons used their now-defunct company, Alanar, to trick about 11,000 investors into buying bonds worth $120 million secured by mortgages on church construction projects.[39]
        Instead, Reeves and his sons diverted money from new investments to pay off previous investors, pocketing $6 million and buying luxuries.[39]

        Stephen Green, 2011

        Stephen Green, a former Chairman of the Conservative Family Campaign who attends an Assemblies of God Church, is head of Christian Voice, a Conservative Christian pressure group in the UK.
        In January 2011, Green's former wife, Caroline Green, accused him of repeatedly physically assaulting her and their children, including one incident where he allegedly beat her with a weapon until she bled, and another in which their son allegedly required hospital treatment after having been beaten with a piece of wood.[40]


        Albert Odulele, 2011

        In February 2011, televangelist and senior pastor of Glory house London: Dr. Albert Odulele was charged with two counts of sexual assault, one involving a 14-year-old boy and another on a 21-year-old man. Although he initially denied the charges, he later pleaded guilty and confessed that he had been battling with his sexuality for many years. He was subsequently sentenced at Woolwich crown court to 8 and 6 months in Prison to run concurrently. He will be on the sex offenders register for 5 years. He is currently serving his sentence. [41]

        Senate probe

        In 2007, Senator Chuck Grassley (R-IA) opened a probe into the finances of six televangelists who preach a "prosperity gospel".[42] The probe investigated reports of lavish lifestyles by televangelists including: fleets of Rolls Royces, palatial mansions, private jets and other expensive items purportedly paid for by television viewers who donate due to the ministries' encouragement of offerings. The six that were investigated are:
        • Creflo Dollar and Taffi Dollar of World Changers Church International and Creflo Dollar Ministries of College Park, Ga;
        • Benny Hinn of World Healing Center Church Inc. and Benny Hinn Ministries of Grapevine, Texas;
        • Eddie L. Long of New Birth Missionary Baptist Church and Bishop Eddie Long Ministries of Lithonia, Ga;
        • Joyce Meyer and David Meyer of Joyce Meyer Ministries of Fenton, Mo; and
        • Randy White and ex-wife Paula White of the multiracial Without Walls International Church and Paula White Ministries of Tampa.
        On January 6, 2011 Senator Grassley released his review of the six ministries response to his inquiry. He called for a further congressional review of tax-exemption laws, and more criminal investigations for the following religious groups, daycares, schools, and evangelists:

        Answer:         The term “televangelist” has almost universally negative overtones. Typical responses from people who are asked what they think about televangelists include the following: dishonest, greedy, materialistic, wasteful, and scandalous. The sight of televangelists wearing overly expensive clothing and jewelry, living in ridiculously expensive homes, and driving the most luxurious of cars, has caused many people to turn away from faith in Christ. Even non-Christians can discern that the teachings and lifestyles of most televangelists are antithetical to the teachings of Jesus Christ.

        There is nothing inherently wrong with televangelism. Television, just like any other medium (such as radio or the internet), is simply one way to get the gospel of Jesus Christ out into the world. There are many godly Christian leaders who use television to advance the gospel. Television is not the cause of the problems in televangelism. The problem in televangelism is the unbiblical beliefs of many televangelists. While television itself is not the problem, it does contribute to the problem in that it is far more difficult to discern a wolf in sheep’s clothing on a television screen than it is to discern such an individual through careful, in-person investigation. Television makes it easier for a facade of godliness and life-changing ministry to be presented, when behind the scenes, all that is truly occurring is a fleecing of unsuspecting sheep.

        The core cause of many televangelist scandals is the belief commonly known as the health-wealth gospel. Televangelists are the primary propagators of the idea that it is always God’s will for all Christians to be perfectly healthy and financially wealthy. The essential message of the health-wealth gospel is that if you give money, God is obligated to bless you with health and wealth. If you give money, but are not blessed with health and wealth, you either did not give enough money, or do not have enough faith to truly receive the blessing. In this, health-wealth televangelists encourage people to give large sums of money, while preemptively explaining why the people are not blessed with health and wealth as they were promised.

        Also known as the “prosperity gospel,” it is decidedly unbiblical. Yes, the Bible encourages believers to give (1 Corinthians 16:2; 2 Corinthians 9:6). And yes, the Bible teaches that those who give generously will be blessed by God (Luke 6:38; 2 Corinthians 9:7). However, the Bible does not teach that we should give SO THAT we will be blessed. The Bible teaches that we should give because we love God and want to thank Him for what He has given us. Our motive for giving should not be so that God will bless us in return. Rather, our motive for giving should be to glorify God and to share the blessings He has given, thereby further expanding His kingdom and promoting the message of the gospel. The message, focus, and motive of the health-wealth televangelists are clearly unbiblical.

        While it is always wrong to motivate giving by unbiblical methods, it would at least be somewhat understandable if these televangelists used the money for godly purposes. Sadly, that is most definitely not the case. It is utterly ridiculous to think that it is God’s desire for televangelists to spend the money donated for their ministry on mansions, while there are hundreds of languages into which not even a portion of the Bible has been translated. It is offensive for televangelists to drive cars that, if sold, could feed a starving African village for months. It is abhorrent that televangelists own clothing outfits that cost more than the average family can afford to spend on clothing in an entire year. To those who have been offended by the many televangelist scandals, please understand this – those televangelists do not represent the Christian faith and they are not following either Jesus’ teachings or His example. Televangelist scandals have truly “given occasion to the enemies of the Lord to blaspheme” (2 Samuel 12:14).

        While it is inconceivable that anyone could truly study the Bible and come away with a belief in the health-wealth gospel that many televangelists espouse, it is possible that some televangelists genuinely believe their message is true, biblical, right, and good. However, whether he believes it or whether he is intentionally and knowingly attempting to fleece people, the result is the same: people are deceived, robbed, and hurt.

        To those Christians who have been deceived and hurt by televangelist scandals: please do not let your experience with televangelists cloud your relationship with Jesus Christ. Study God’s Word (2 Timothy 3:16-17), and you will see the true message of the gospel. To those non-Christians for whom televangelism is a reason for your rejection of the Christian faith: do not reject faith in Jesus Christ due to the lies, deceptions, ungodly teachings, and unholy lifestyles of the televangelists.

Needless to say, the charges was eventually dropped, followed by a civil lawsuit (one of many for uninfortunate circumstances like this which happens all too often in The South, and places like Augusta and Aiken County.)           Biologists John Tooby and Leda Cosmides were puzzled by the fact that race is one of the three characteristics most often used in brief descriptions of individuals (the others are age and sex). They reasoned that natural selection would not have favoured the evolution of an instinct for using race as a classification, because for most of human history, humans almost never encountered members of other races. Tooby and Cosmides hypothesized that modern people use race as a proxy (rough-and-ready indicator) for coalition membership, since a better-than-random guess about "which side" another person is on will be helpful if one does not actually know in advance.
          Their colleague Robert Kurzban designed an experiment whose results appeared to support this hypothesis. Using the Memory confusion protocol, they presented subjects with pictures of individuals and sentences, allegedly spoken by these individuals, which presented two sides of a debate. The errors which the subjects made in recalling who said what indicated that they sometimes misattributed a statement to a speaker of the same race as the "correct" speaker, although they also sometimes misattributed a statement to a speaker "on the same side" as the "correct" speaker. In a second run of the experiment, the team also distinguished the "sides" in the debate by clothing of similar colors; and in this case the effect of racial similarity in causing mistakes almost vanished, being replaced by the color of their clothing. In other words, the first group of subjects, with no clues from clothing, used race as a visual guide to guessing who was on which side of the debate; the second group of subjects used the clothing color as their main visual clue, and the effect of race became very small.           Some research suggests that ethnocentric thinking may have actually contributed to the development of cooperation. Political scientists Ross Hammond and Robert Axelrod created a computer simulation wherein virtual individuals were randomly assigned one of a variety of skin colors, and then one of a variety of trading strategies: be color-blind, favor those of your own color, or favor those of other colors. They found that the ethnocentric individuals clustered together, then grew until all the non-ethnocentric individuals were wiped out.[61]
          In The Selfish Gene, evolutionary biologist Richard Dawkins writes that "Blood-feuds and inter-clan warfare are easily interpretable in terms of Hamilton's genetic theory." Dawkins writes that racial prejudice, while not evolutionarily adaptive, "could be interpreted as an irrational generalization of a kin-selected tendency to identify with individuals physically resembling oneself, and to be nasty to individuals different in appearance".[62] Simulation-based experiments in evolutionary game theory have attempted to provide an explanation for the selection of ethnocentric-strategy phenotypes.[63]

          Authors such as Hannah Arendt, in her 1951 book The Origins of Totalitarianism, have said that the racist ideology (popular racism) which developed at the end of the 19th century helped legitimize the imperialist conquests of foreign territories and the acts that accompanied them (such as the Herero and Namaqua Genocide of 1904–1907 or the Armenian Genocide of 1915–1917). Rudyard Kipling's poem The White Man's Burden (1899) is one of the more famous illustrations of the belief in the inherent superiority of the European culture over the rest of the world, though also it is also thought to be a satirical appraisal of such imperialism. Racist ideology thus helped legitimize subjugation and the dismantling of the traditional societies of indigenous peoples, which were regarded as humanitarian obligations as a result of these racist beliefs.
          However, during the 19th century, West European colonial powers were involved in the suppression of the Arab slave trade in Africa,[88] as well as in suppression of the slave trade in West Africa.[89] Other colonialists recognized the depravity of their actions but persisted for personal gain; some Europeans during the time period objected to the injustices caused by colonialism and lobbied on behalf of aboriginal peoples. Thus, when the Hottentot Venus was displayed in England in the beginning of the 19th century, the African Association publicly opposed itself to the exhibition. The same year that Kipling published his poem, Joseph Conrad published Heart of Darkness (1899), a clear criticism of the Congo Free State owned by Leopold II of Belgium.
          Examples of racial theories used include the creation of the Hamitic ethno-linguistic group during the European exploration of Africa. It was then restricted by Karl Friedrich Lepsius (1810–1877) to non-Semitic Afro-Asiatic languages.[90]
          The term Hamite was applied to different populations within Africa, mainly comprising Ethiopians, Eritreans, Somalis, Berbers, and Nubians. Hamites were regarded as Caucasoid peoples who probably originated in either Arabia or Asia on the basis of their cultural, physical and linguistic similarities with the peoples of those areas.[91][92][93] Europeans considered Hamites to be more civilized than Black Africans, and more akin to themselves and Semitic peoples.[94] In the first two-thirds of the 20th century, the Hamitic race was, in fact, considered one of the branches of the Caucasian race, along with the Indo-Europeans, Dravidians, Semites, and the Mediterranean race.
          However, the Hamitic peoples themselves were often deemed to have failed as rulers, which was usually ascribed to interbreeding with Negroes. In the mid-20th century, the German scholar Carl Meinhof (1857–1944) claimed that the Bantu race was formed by a merger of Hamitic and Negro races. The Hottentots (Nama or Khoi) were formed by the merger of Hamitic and Bushmen (San) races — both being termed nowadays as Khoisan peoples).
          In the United States in the early 19th century, the American Colonization Society was established as the primary vehicle for proposals to return black Americans to greater freedom and equality in Africa.[95] The colonization effort resulted from a mixture of motives with its founder Henry Clay stating; "unconquerable prejudice resulting from their color, they never could amalgamate with the free whites of this country. It was desirable, therefore, as it respected them, and the residue of the population of the country, to drain them off".[96] Racism spread throughout the New World in the late 19th century and early 20th century. Whitecapping, which started in Indiana in the late 19th century, soon spread throughout all of North America, causing many African laborers to flee from the land they worked on. In the US during the 1860s, racist posters were used during election campaigns. In one of these racist posters (see above), a black man is depicted lounging idly in the foreground as one white man ploughs his field and another chops wood. Accompanying labels are: "In the sweat of thy face shalt thou eat thy bread," and "The white man must work to keep his children and pay his taxes." The black man wonders, "Whar is de use for me to work as long as dey make dese appropriations." Above in a cloud is an image of the "Freedman's Bureau! Negro Estimate of Freedom!" The bureau is pictured as a large domed building resembling the U.S. Capitol and is inscribed "Freedom and No Work." Its columns and walls are labeled, "Candy," "Rum, Gin, Whiskey," "Sugar Plums," "Indolence," "White Women," "Apathy," "White Sugar," "Idleness," and so on.
          On June 5, 1873, Sir Francis Galton, distinguished English explorer and cousin of Charles Darwin, wrote in a letter to The Times:
          "My proposal is to make the encouragement of Chinese settlements of Africa a part of our national policy, in the belief that the Chinese immigrants would not only maintain their position, but that they would multiply and their descendants supplant the inferior Negro race" "I should expect that the African seaboard, now sparsely occupied by lazy, palavering savages, might in a few years be tenanted by industrious, order-loving Chinese, living either as a semidetached dependency of China, or else in perfect freedom under their own law."           The Nazis considered Jews, Gypsies, Poles and other Slavic people such as the Russians, Ukrainians, Czechs and anyone else who was not an "Aryan" according to the contemporary Nazi race terminology to be subhuman (Untermensch). The Nazis rationalized that the Germans, being a super human (Übermenschlich) race, had a biological right to displace, eliminate and enslave inferiors.[99] Some 6 million Jews were killed by the Nazis during the Holocaust. In the longer term,[100] the Nazis wanted to exterminate some 30–45 million Slavs.[101] After the war, under the "Big Plan", Generalplan Ost foresaw the eventual expulsion of more than 50 million non-Germanized Slavs of Eastern Europe through forced migration, as well as some of the Balts, beyond the Ural Mountains and into Siberia. In their place, Germans would be settled in an extended "living space" (Lebensraum) of the 1000-Year Empire (Tausendjähriges Reich). Herbert Backe was one of the orchestrators of the Hunger Plan – the plan to starve tens of millions of Slavs in order to ensure steady food supplies for the German people and troops.[102] Heinrich Himmler speech to about 100 SS Group Leaders in Posen, occupied Poland, 1943:
          "What happens to the Russians, what happens to the Czechs, is a matter of utter indifference to me...           Serious race riots in Durban between Indians and Zulus erupted in 1949.[104] Ne Win's rise to power in Burma in 1962 and his relentless persecution of "resident aliens" led to an exodus of some 300,000 Burmese Indians.[105] They migrated to escape racial discrimination and wholesale nationalisation of private enterprise a few years later in 1964.[106] The Zanzibar Revolution of January 12, 1964 put an end to the local Arab dynasty.[107] Thousands of Arabs and Indians in Zanzibar were massacred in riots, and thousands more were detained or fled the island.[108] On 4 August 1972, Idi Amin, President of Uganda, ethnically cleansed Uganda's Asians giving them 90 days to leave the country.[109]

          Contemporary

          During the Congo Civil War (1998–2003), Pygmies were hunted down like game animals and eaten. Both sides of the war regarded them as "subhuman" and some say their flesh can confer magical powers. UN human rights activists reported in 2003 that rebels had carried out acts of cannibalism. Sinafasi Makelo, a representative of Mbuti pygmies, has asked the UN Security Council to recognise cannibalism as a crime against humanity and an act of genocide.[110] A report released by the United Nations Committee on the Elimination of Racial Discrimination condemns Botswana's treatment of the 'Bushmen' as racist.[111]
          The mass demonstrations and riots against African students in Nanjing, China, lasted from December 1988 to January 1989.[112] Bar owners in central Beijing had been forced “not to serve black people or Mongolians” during the 2008 Summer Olympics.[113] Some neighborhood committees in Guangzhou bar Africans from living in residential complexes.[114] In November 2009, British newspaper The Guardian reported that Lou Jing, of mixed Chinese and African parentage, had emerged as the most famous talent show contestant in China and has become the subject of intense debate because of her skin colour.[115] Her attention in the media opened serious debates about racism in China and racial prejudice.[116]
          In Asia and Latin America, light skin is seen as more attractive.[117] Thus, skin whitening cosmetic products are popular in East Asia[118] and India.[119]
          Some 70,000 black African Mauritanians were expelled from Mauritania in the late 1980s.[120] In the Sudan, black African captives in the civil war were often enslaved, and female prisoners were often used sexually.[121] The Darfur conflict has been described by some as a racial matter.[122] In October 2006, Niger announced that it would deport the Arabs living in the Diffa region of eastern Niger to Chad.[123] This population numbered about 150,000.[124] While the Government collected Arabs in preparation for the deportation, two girls died, reportedly after fleeing Government forces, and three women suffered miscarriages.[125]
          The Ethiopian Jewish community's integration into Israeli society has been complicated by racist attitudes on the part of some elements of Israeli society and the official establishment.[126][127] The Israeli media reported that residents of Pisgat Ze'ev, a large Jewish settlement in East Jerusalem, had formed a vigilante-style patrol to stop interracial dating between Arab men and local Jewish girls. In the 2007 poll, more than half of Israeli Jews said that intermarriage should be equated with “national treason”.[128]

          The Jakarta riots of May 1998 targeted many Chinese Indonesians.[129] The anti-Chinese legislation was in the Indonesian constitution until 1998. Xenophobia against Chinese migrants is currently on the rise in Africa[130][131][132] and Oceania.[133][134] Anti-Chinese rioting, involving tens of thousands of people,[135] broke out in Papua New Guinea in May 2009.[136] The Fiji coup of 2000 has provoked a violent backlash against the Indo-Fijians.[137] Fiji citizens of Indian, European, mixed race or other island heritage have become second-class citizens.[138][139] Racial divisions also exist in Guyana[140] and Malaysia.[141]

          Inter-minority variants

          Prejudiced thinking among and between minority groups does occur, for example conflicts between African Americans and Korean Americans (notably in the Los Angeles riots of 1992), by blacks towards Jews (such as the riots in Crown Heights in 1991), between new immigrant groups (such as Latinos), or towards whites.[142][143][144][145] One particularly pernicious form of racism in the United States is racial segregation, which arguably continues to exist today.[146]
          There has been a long-running racial tension between African Americans and Mexican Americans.[147][148][149] There have been several significant riots in California prisons in which Mexican American inmates and African Americans have specifically targeted each other based on racial reasons.[150][151] There have been reports of racially motivated attacks against African Americans who have moved into neighborhoods occupied mostly by Mexican Americans, and vice versa.[152][153][154][155] In the late 1920s in California, there was animosity between the Filipinos and the Mexicans and between European Americans and Filipino Americans since they competed for the same jobs.[156] Recently, there has also been an increase in racial violence between African immigrants and Blacks who have already lived in the country for generations.[157]
          The Aztlan movement has been described as racist. The movement's goal is repossession of the American southwest. It has also been called the Mexican "reconquista" (re-conquest) whose name was inspired by the Spanish reconquista, which led to the expulsion of the Moors from Spain.[158] According to gang experts and law enforcement agents, a longstanding race war between the Mexican Mafia and the Black Guerilla family, a rival African American prison gang, has generated such intense racial hatred among Mexican Mafia leaders or shot callers, that they have issued a "green light" on all blacks. A sort of gang-life fatwa, this amounts to a standing authorization for Latino gang members to prove their mettle by terrorizing or even murdering any blacks sighted in a neighborhood claimed by a gang loyal to the Mexican Mafia.[159]
          In Britain, tensions between minority groups can be just as strong as those between minorities and the majority population. In Birmingham, there have been long-term divisions between the Black and South Asian communities, which were illustrated in the Handsworth riots and in the smaller 2005 Birmingham riots. In Dewsbury, a Yorkshire town with a relatively high Muslim population, there have been tensions and minor civil disturbances between Kurds and South Asians.[160][161]
          In France, home to Europe’s largest population of Muslims — about 6 million — as well as the continent’s largest community of Jews, about 600,000, anti-Jewish violence, property destruction, and racist language has been increasing over the last several years. Jewish leaders perceive the Muslim population as intensifying anti-Semitism in France, mainly among Muslims of Arab or African heritage, but also this anti-Semitism is perceived as also growing among Caribbean islanders from former colonies.[162][163]

          International Day for the Elimination of Racial Discrimination

          UNESCO marks March 21 as the yearly International Day for the Elimination of Racial Discrimination, in memory of the events that occurred on March 21, 1960 in Sharpeville, South Africa, where police killed student demonstrators peacefully protesting against the apartheid regime.
